Please note that per Hamilton Southeastern School’s Use of School Facilities Procedure Section V number 17: All non-school groups who are permitted to use school facilities as required by the Equal Access Act and who provide materials advertising their activities held in school facilities are required to include the following statement on those materials: Permitted use of school facilities as required by the Equal Access Act is not an endorsement of this group or this group’s beliefs by Hamilton Southeastern Schools or the Board of School Trustees. This is to include any flyers, brochures, announcements in school newsletters, etc.

Pursuant to Indiana Code 34-31-10, the School Board may designate and approve certain types of activities as a “community use physical fitness activity.” Subject to the exceptions set forth in the statute, a school corporation is not liable for the injury of a participant in a “community use physical fitness activity” if the injury is caused by an inherent risk of the activity. The statute, however, does not apply to situations where a student or employee is injured while using the school’s facilities or equipment in the course of school employment or an official school function.
Pursuant to Ind. Code 34-31-10-12, the Hamilton Southeastern Schools (“HSE”) Board of School Trustees designates and approves the following types of activities as “community use physical fitness activities”: Those activities in which the general public is invited to use HSE property, equipment, or a facility to participate in a physical fitness activity. “Community use physical fitness activities” include, but are not limited to, the following types of activities: Band competitions, Basketball, Baseball, Cheerleading, Conditioning, Strength Training, Agility Activities, Church activities, Cycling, Dance, Exercising, Football, Golf, Gymnastics, Lacrosse, Law Enforcement activities and training, Martial Arts, Power Soccer/Basketball, Rugby, Running, Soccer, Softball, Swimming, Tennis, Use of Playground Equipment, Volleyball, Yoga, Weightlifting, Other Weight/Fitness Room Activities, and Wrestling.
By enacting this policy on June 9, 2014 the Board intends to take the liability protections offered in Indiana Code 34-31- 10.
The Superintendent/designee shall take all actions necessary to carry out this policy and to implement the steps I.C. 34- 31-10 requires for schools to take the liability protections offered by the statute.
WARNING Under Indiana law, a school is not liable for an injury to, or the death of, a participant in physical fitness activities at this location if the death or injury results from the inherent risks of the physical fitness activity. Inherent risks of physical fitness activities include risks of injury inherent in exercise, the nature of a sport, the use of exercise equipment, or the use of a facility provided by a school. Inherent risks also include the potential that you may act in a negligent manner that may contribute to your injury or death, or that other participants may act in a manner that may result in injury or death to you.
